Madden began his practice of law with the Denver firm of Davis, Graham and Stubbs as an Associate in the corporate, and trust and estate departments. After three years, he received an appointment as an Assistant US Attorney for the District of Colorado, serving for more than three years. He first served in the general criminal and civil categories, trying cases in the U.S. District Court for the District of Colorado and appeals before the Tenth Circuit Court of Appeals. After prosecuting a number of federal drug cases, Madden was detailed as the Special Attorney in Charge of a Colorado joint federal and state narcotic strike force, which investigated and prosecuted its own cases. He then served in the major trial section, trying cases regarding tax evasion, securities fraud, other white-collar crimes and torts against the government, including a personal injury action, a defamation case and a large condemnation case.

Following his service in the United States Attorney’s office, Madden joined the Denver firm of Brownstein Hyatt Farber & Madden as a name partner, heading the litigation section for almost 20 years. He represented both plaintiffs and defendants and litigated and tried matters in almost all areas of commercial and business litigation, as well as in almost all other areas of litigation. In this respect, he represented a number of production builders and commercial developers. Among these was MDC/Richmond for which Madden coordinated and oversaw it litigation for five years for more than 10 states, including co-heading the defense of a class action warranty and construction defect case involving more than 2,000 homes. During his time at the Brownstein firm, Madden also served on leave for two years as the Director of the Denver Regional Office of the Federal Trade Commission regarding its Antitrust, Consumer Protection, and other Trade Restraint Jurisdictions.

After his practice with the Brownstein firm, Madden formed the law firm of Madden & Madden with his son John W. Madden, IV, who had just finished serving four years as a Deputy District Attorney with the Denver District Attorney Office. They formed a small boutique firm specializing in civil litigation and practiced together for 11 years until his son was appointed to the Denver District Court Bench. Thereafter, Madden continued the firm’s practice as The Madden Law Firm, and also served as “of counsel” to the Denver law firms of Bennington Johnson Bierman & Craigmile and Coan Payton & Payne, LLC.

In addition to serving over the years as counsel for clients under their insurance coverage, Madden has represented clients in actions against insurance companies for bad faith and breach of duty.

He also acted as “coverage” counsel for The Hartford Insurance Company and counsel for the Metropolitan Life Insurance Company, regarding a variety of cases. Further, he has been accepted as an expert witness in a number of actions and has testified as to issues of legal malpractice, the reasonableness of litigation costs, and the terms of litigation settlements.
